GST Refund for Engineering Exporters

GST Refund for Engineering Exporters

Why does a machinery exporter with full order books still wait months for GST money? GST refunds for engineering exporters can be delayed due to documentation gaps, mismatches between shipping bills and GST returns, and incorrect refund claims. Understanding the difference between exporting under a Letter of Undertaking (LUT) and paying IGST on exports can help exporters choose the appropriate option and manage eligible input tax credit (ITC).

This EEPC India GST compliance guide shows how to choose the right route, protect capital goods credit, and file cleanly, with the 2026 updates that matter.

How Can Engineering Exporters Claim GST Refund? Four Routes

Each route rests on a different provision, so your choice decides both speed and amount.

Route

Legal basis

How you claim

Capital goods credit

Export with IGST payment

Section 16(3)(b) IGST Act, Rule 96

Shipping Bill acts as the application

Can fund the IGST payment

Export under LUT

Section 16(3)(a), Rule 89(4), Rule 96A

RFD-11, then RFD-01

Excluded

Inverted duty structure

Section 54(3)(ii), Rule 89(5)

RFD-01 with Statement 1A

Excluded

Deemed export (EPCG supplies)

Section 147, Notification 48/2017-CT

RFD-01 with Statement 5B

Tax on that supply is refundable

Merchant exporters procuring goods under applicable concessional-rate notifications should verify the conditions governing the supply and the export transaction before claiming a refund. The omission of Rule 96(10) should be assessed in light of the applicable notification, effective date, and relevant facts of the claim

Why Is ITC on Capital Goods Not Refundable Under LUT?

Problem: Machinery credit piles up while exports keep flowing.

Why it happens:

  • Section 54(3)(ii) speaks of inputs, and Section 2(59) defines inputs as goods other than capital goods.
  • Net ITC under Rule 89(4) covers inputs and input services only.
  • The Supreme Court upheld the input-goods restriction in VKC Footsteps (2021). Rule 89(5) was reworked by Notification 14/2022-CT from 5 July 2022.

Capital goods ITC is not included in the Net ITC calculation for refunds under Rule 89(4). However, eligible unutilised credit may remain available in the electronic credit ledger for utilisation against eligible output tax liabilities, subject to the applicable provisions. Exporters should evaluate the available refund routes and credit utilisation options based on their transaction profile.

Capital Goods Export GST Refund: Four Ways to Recover Locked Credit

1. Export on payment of IGST: Eligible ITC may be utilised to discharge the IGST liability on eligible exports, subject to applicable utilisation rules and restrictions. The refund of IGST paid on exports is processed through the prescribed customs and GST systems, subject to validation and eligibility conditions. ITC that is blocked according to  Section 17(5) cannot be treated as eligible credit.

2. EPCG scheme: Eligible exporters may import capital goods under the Export Promotion Capital Goods (EPCG) scheme subject to the applicable Foreign Trade Policy and customs conditions. The duty benefits, export obligation, and applicable timelines should be verified under the current scheme provisions before making a procurement decision.

3. Evaluate eligible domestic procurement: Certain supplies made against an Advance Authorisation or EPCG Authorisation may qualify as deemed exports if the prescribed conditions are met. Refund eligibility, the eligible claimant, required undertakings, and any export-obligation benefits must be checked against the applicable GST notifications and Foreign Trade Policy. The same tax amount cannot be refunded twice.

4. Use the credit against domestic output tax.

Step-by-Step Export Refund Under GST for Engineering Goods

With the route chosen, the workflow below keeps every claim audit-ready.

Step

Action

Key point

1

Set up GSTIN, IEC, and RCMC from EEPC India

Validate the bank account for PFMS

2

File LUT (RFD-11)

Before the first export of each financial year

3

Issue the invoice and file the shipping bill

The carrier files the EGM

4

Report in GSTR-1 Table 6A and GSTR-3B Table 3.1(b)

Due on the 11th and 20th for monthly filers

5

IGST route: wait for ICEGATE validation

Rule 96 needs GSTR-3B and the EGM

6

LUT route: file RFD-01

Verify the applicable limitation period and relevant date under Section 54 and the GST Rules for the specific refund category

7

Track RFD-02 (15 days) and provisional refund and final sanction

Monitor the application status and respond to deficiency memos or verification requests. The applicable statutory timelines depend on the stage of processing and the type of claim. Interest provisions apply subject to the conditions under Section 56

8

Realise export proceeds within the FEMA period

Otherwise, Rule 96B recovery applies

Documents Required for GST Refund on Exports

  • LUT acknowledgement, IEC, and tax invoices
  • Shipping bill and EGM details
  • GSTR-1, GSTR-3B and the RFD-01 statements
  • Purchase register reconciled with GSTR-2B
  • Bank Realisation Certificate (BRC), Foreign Inward Remittance Certificate (FIRC), or other prescribed evidence of payment realisation, wherever applicable to the refund category. Exporters should separately verify the applicable GST documentation and FEMA requirements for goods or services.

Calculation Example: LUT Refund Versus IGST Refund

  • Assume eligible zero-rated turnover of ₹8 crore, adjusted total turnover of ₹10 crore, and Net ITC of ₹90 lakh.
  • Illustrative LUT refund: Using the Rule 89(4) formula, the calculation is ₹8 crore × ₹90 lakh ÷ ₹10 crore = ₹72 lakh, subject to the applicable formula, limits, and eligibility conditions.
  • Capital goods ITC: Capital goods credit is excluded from Net ITC under Rule 89(4). The amount of any remaining credit must be determined from the taxpayer's actual
    electronic credit ledger and utilisation.
  • Illustrative IGST amount: At an assumed IGST rate of 18%, the tax on ₹8 crore would be ₹1.44 crore if the entire turnover is eligible and that rate applies. This is an illustrative tax calculation, not a guaranteed refund amount.
  • The actual route should be selected after reviewing the applicable law, available credit, cash-flow requirements, and export eligibility.

Shipping Bill as Refund Application on ICEGATE: Rejection Reasons and Fixes

Common reasons for rejection of exporter GST refund are mostly data problems, so most are fixable.

Problem

Why it happens

Fix

SB001, SB003, SB005

Wrong shipping bill details, GSTIN, or invoice number in GSTR-1

Amend through Table 9A

SB002, SB006

EGM not filed, or gateway EGM missing for ICD exports

Follow up with the carrier or gateway customs

Low Net ITC

Supplier filed GSTR-1 late, so credit is missing from GSTR-2B

Reconcile monthly

Wrong inverted duty claim

Capital goods or services included

Compute on input goods per the amended Rule 89(5)

Double benefit

Drawback that includes GST, claimed with a refund

Claim only the customs component of drawback

To track an IGST export refund on ICEGATE: log in, open the IGST refund enquiry, note the SB code, fix the mismatch, then recheck after re-transmission.

Conclusion

Choosing the appropriate GST refund route, maintaining accurate records and reconciling shipping bill data with GST returns can help engineering exporters reduce avoidable refund delays. Businesses with significant capital goods investments should assess ITC utilisation, export eligibility and the applicable refund provisions before selecting a filing strategy.

MYGST Refund helps businesses improve GST visibility and manage refund-related data and reconciliation workflows. Exporters can review their IGST and LUT transactions, identify data discrepancies, and assess their GST refund documentation before filing a claim.

Frequently Asked Questions(FAQ’s)

1. How can engineering exporters claim GST refund?
Pay IGST and use the ICEGATE route, or export under LUT and file RFD-01. Deemed exports and inverted duty claims use separate statements.

2. Can capital goods ITC be refunded?
Not under Rule 89(4) or 89(5). Use IGST payment, EPCG, or deemed-export routes instead.

3. LUT or IGST payment, which is better?
GST payment monetises capital goods credit. LUT avoids cash outflow but excludes that credit.

4. Is refund on machinery available to everyone?
No. Ordinary machinery purchases only create ITC, apart from EPCG deemed-export supplies.
